Terms of Use

Effective September 15, 2026 · Version 2026-09-15

These Terms of Use (the “Terms”) are a legal agreement between you and Open Cloud LLC (“Open Cloud”, “we”, “us”) for the Milkloft application for iPhone and iPad, its widgets and Live Activities, the Milkloft Pro purchase, and the milkloft.com website (together, “Milkloft” or the “app”). By turning on the acceptance switch in the app, by installing or using the app, or by using the website, you accept these Terms and our Privacy Policy. If you do not agree, do not use Milkloft.

Please read them. They contain important information about what Milkloft is and is not, about the estimated dates it shows, and about the limits of our responsibility.

1. Who you are contracting with

Your agreement is with Open Cloud LLC, the developer and publisher of Milkloft, and not with Apple Inc. (“Apple”). Apple distributes the app through the App Store and processes purchases, but Apple is not a party to these Terms and has no responsibility for the app or its content. Section 21 sets out additional terms that apply because the app is distributed through the App Store.

These Terms apply together with the App Store terms that govern your Apple Account and purchases (Apple’s Media Services Terms and Conditions). Where Apple’s standard Licensed Application End User License Agreement would otherwise apply to Milkloft, these Terms replace it to the extent permitted, and Apple keeps the rights described in Section 21.

2. Who may use Milkloft

  • You must be at least 18 years old and have the legal capacity to enter into a contract. Milkloft is designed for adults who express and store their own milk or manage a household milk stash. It is not directed to minors.
  • You may use Milkloft only for your personal, non-commercial purposes: managing milk for your own baby or a baby in your care. Milkloft is not licensed for use by milk banks, hospitals, clinics, childcare businesses, or any professional or institutional setting, and it is not designed for such use.
  • You must not be located in a country subject to a United States government embargo or designated by the United States as a “terrorist supporting” country, and you must not be listed on any United States government list of prohibited or restricted parties.

3. What Milkloft is, and what it is not

Milkloft is an organizational tool. It helps you record expressed milk, keep an inventory by location, see which bag to use first, estimate when milk may pass its recommended storage window, and plan your stash ahead of a return to work.

Milkloft is not a medical device, is not a healthcare service, and does not provide medical, nutritional, or lactation advice. Nothing in the app, in its notifications, in its exports, or on the website is medical advice, and using Milkloft does not create a doctor-patient, clinician-patient, or any other professional relationship between you and Open Cloud.

Every decision about expressing, storing, thawing, preparing, feeding, donating, or discarding milk is yours. Follow the instructions of your pediatrician, lactation consultant, or other healthcare professional. If they conflict with anything Milkloft shows, follow your healthcare professional. If your baby was born prematurely, is hospitalized, has a medical condition, or has special feeding needs, do not rely on Milkloft’s general estimates; ask your baby’s care team what applies to you.

4. Estimated dates and storage guidelines

  • Every storage window, expiration date, “use before” time, thaw countdown, power-outage suggestion, and “use first” answer in Milkloft is an estimate. The app labels them as such.
  • Estimates are calculated from published storage guidelines from public bodies and professional organizations (the CDC guideline is the default; you can select others, and the source is shown in the app). We reproduce these guidelines as published; we do not verify them, we do not update them in real time, and they may change, be revised, or be superseded after we publish an app version.
  • You can view and adjust the rules the app applies. If you adjust them, every estimate that depends on them changes accordingly, and you are responsible for the values you choose.
  • General guidelines cannot account for your fridge, your freezer, your milk, your baby, or your circumstances. An estimate is not a guarantee that milk is safe to use before the date shown, nor that it is unsafe after it.
  • Milkloft is not affiliated with, endorsed by, or certified by the CDC, the Academy of Breastfeeding Medicine, the NHS, the American Academy of Pediatrics, NICE, or any other organization whose guidance it cites, or by Apple.

5. The app records what you tell it

Milkloft has no sensors and no way to observe your milk, your fridge, your freezer, or your cooler. Everything it shows (statuses, estimated dates, warnings, projections, plans, and suggestions) is computed from the information you enter: when milk was expressed, where you say it is, when you say it was moved, thawed, offered, left out, or discarded, and the details you enter about your baby.

Keeping that record accurate, complete, and up to date is your responsibility. The app cannot detect what you do not log, including power outages, an open freezer door, a broken appliance, thawing, refreezing, contamination, or spoilage. Before feeding, always check the milk itself and use your own judgment.

6. Notifications, Live Activities, and widgets

Reminders are local notifications scheduled on your device; Live Activities and widgets are displayed by your device from data stored on it. None of them are sent from a server. Whether and when they appear depends on your permission, your device settings, Focus modes, Low Power Mode, system limits, and the version of iOS you run, and is not guaranteed. They are a convenience, not a safety mechanism. Do not rely on them as your only check on stored milk.

7. Your data, backups, and iCloud

  • Your data lives on your device and, if you are signed in to iCloud and have it enabled, in the private iCloud database associated with your Apple Account. We do not operate servers, do not hold a copy of your data, and cannot access, recover, restore, or transfer it. See the Privacy Policy. If you share your stash or join someone else’s, Section 8 describes who can see and edit it.
  • You are responsible for keeping backups. The app makes automatic periodic snapshots within its own storage on your device and lets you export a full backup (JSON) and spreadsheets (CSV) at any time; keep copies somewhere you control. Deleting the app deletes its data from that device, and deleting the app’s iCloud data removes the synced copy.
  • Sync, iCloud Backup, and Family Sharing depend on Apple’s services, your Apple Account, your settings, available storage, and connectivity. We are not responsible for their availability, for sync conflicts, or for data lost or altered because of them.
  • Restoring a backup replaces the data on the device you restore to. Make sure you restore the file you intend to.

8. Exports, labels, and sharing

Milkloft can produce documents that leave the app: a caregiver handoff sheet (PDF), CSV exports, JSON backups, and QR labels for your bags. Once you export, print, share, AirDrop, email, or save one of them, it is outside the app and outside our control. You decide with whom you share them, and you are responsible for that sharing and for anything the recipient does with it. A caregiver sheet is a summary of what you logged, not an instruction from us; anyone who uses it should also follow your instructions and those of your baby’s healthcare professional.

Shared stash. With Milkloft Pro, you can share your stash through iCloud with other people, each using Milkloft on their own device with their own Apple Account.

  • A shared stash has room for up to 6 people in total, including you. Only the person who shares the stash can invite people, and they need Milkloft Pro to do so; they can also remove a person. The people invited do not need Pro of their own. If Pro stops being available to the person who shares, the stash stays shared, but nobody new can be invited.
  • You decide whom you invite, and you are responsible for that choice. Everyone you invite can see the stash, including the details about your baby kept with it, and can edit it (for example, log, move, use, or discard bags). Their changes apply to the stash for everyone in it.
  • If someone invites you to their stash, you can see and edit it in the same way, and what you record in it becomes part of their stash.
  • You can stop sharing at any time, and anyone in a shared stash can leave it at any time. Either way, that access ends. Stopping sharing does not delete the stash from your device, and leaving does not change the leaving person’s own stash. Anything a person exported or saved from the stash before their access ended stays with them, as described above.
  • A shared stash lives in the iCloud of the person who shared it and depends on Apple’s services, as described in Section 7. The others keep their access until that person stops sharing or removes them, or until they leave the stash. If that person deletes the app’s iCloud data, the others lose access too.
  • Sharing does not change what Milkloft is. Section 3 applies to everyone in a shared stash: nothing in it is medical advice, and whoever feeds a baby from it remains responsible for checking the milk and following the baby’s healthcare professional.

9. Chapters and information about your baby

You may enter information about your baby (an optional name, a date of birth, and a weight) to improve the app’s estimates, and, with Milkloft Pro, close a chapter and start the next baby’s. You confirm that you are the parent or legal guardian of any baby whose information you enter, or that you have their parent’s or guardian’s permission. That information stays on your device and your iCloud like the rest of your data, or in a shared stash (see Section 8).

10. License

Subject to these Terms, Open Cloud grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Milkloft on Apple-branded devices that you own or control, as permitted by the Usage Rules in the App Store terms. The license also covers other members of your Apple Family who receive the app or Milkloft Pro through Family Sharing, each of whom must also accept these Terms.

You may not, and may not allow anyone else to: copy the app except as permitted by the Usage Rules; sell, rent, lend, sublicense, or redistribute it; modify, translate, or create derivative works of it; decompile, reverse engineer, or attempt to extract its source code, except to the extent the law expressly allows despite this restriction; remove or alter any notice of ownership; bypass any feature limit, purchase, or technical protection; use the app in a way that violates any law, harms anyone, or infringes anyone’s rights; or use it to develop a competing product.

We may update the app, change or remove features, change the limits of the free tier, and require you to install updates to keep using it. We do not promise that any feature will remain available forever or that the app will support any particular device or version of iOS. We may discontinue the app, in which case your data remains on your device and in your iCloud, and you can export it at any time.

11. Purchases: Milkloft Pro

  • The app is free to download and use within the free tier. Milkloft Pro is a one-time, non-consumable in-app purchase that unlocks the Pro features described in the app. It is not a subscription, and it does not renew.
  • Purchases are made through Apple, under your Apple Account and the App Store terms. The price is the one shown in the App Store for your country or region at the time of purchase, including any applicable taxes. We do not process payments and never receive your payment details.
  • Refunds are handled by Apple under its refund policies. We cannot issue, approve, or deny a refund. Contact Apple or use reportaproblem.apple.com.
  • Milkloft Pro is enabled for Family Sharing. Whether it is shared, with whom, and for how long depends on your Apple Family settings and on Apple’s rules. Sharing the purchase does not share your data: each person’s stash lives on their own device and iCloud, unless they share it as described in Section 8. The family organizer may stop sharing at any time; if that happens, Pro features become unavailable to the affected members, and nothing they logged is deleted. To recover a purchase on a new device or as a family member, use “Restore purchase” in the app.
  • “Free updates” and similar phrases mean that the updates of the app we choose to publish are included in your purchase at no extra charge. They are not a promise to build any specific feature, to keep any feature, to publish updates on any schedule, or to offer the app indefinitely.
  • If Apple revokes a purchase (for example after a refund or a chargeback), the corresponding Pro features stop being available.

12. Maintenance and support

Open Cloud, not Apple, is responsible for the app and for providing any maintenance and support for it. You can reach us at [email protected] or through the feedback option in the app. We answer in English and Spanish and try to respond promptly, but we do not promise response times, fixes, or that support will always be available. Apple has no obligation to provide maintenance or support for Milkloft.

13. Intellectual property

Milkloft, including its software, design, text, graphics, icons, calculations, and the “Milkloft” name and logo, is owned by Open Cloud or its licensors and is protected by copyright, trademark, and other laws. These Terms do not transfer any ownership to you; you receive only the license in Section 10. Your data is yours; we claim no rights over the information you log or the documents you export.

If you send us suggestions, feedback, or ideas, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without any obligation to you.

Apple, App Store, iPhone, iPad, iCloud, and Dynamic Island are trademarks of Apple Inc. Other names mentioned belong to their owners and are used only to identify them.

Milkloft relies on Apple services (iCloud, CloudKit, the App Store, StoreKit, and notifications) that are governed by Apple’s terms and privacy policy. The app and the website may link to third-party websites, such as the organizations that publish the storage guidelines. We do not control those sites or services and are not responsible for their content, availability, or practices. Using them is subject to their own terms.

15. Disclaimer of warranties

To the maximum extent permitted by applicable law, Milkloft is provided “as is” and “as available”, with all faults, and without warranty of any kind. Open Cloud disclaims all warranties, express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and any warranty arising from course of dealing or usage of trade. In particular, we do not warrant that the app will be error-free or uninterrupted, that estimates, projections, plans, or notifications will be accurate, timely, or suitable for your situation, that any defect will be corrected, or that the app or its data will be free of loss or corruption. No advice or information, oral or written, obtained from us or through the app creates any warranty.

Some jurisdictions do not allow the exclusion of certain warranties; if that applies to you, the exclusions above apply to the maximum extent permitted, and Section 20 applies.

16. Limitation of liability

To the maximum extent permitted by applicable law:

  • Open Cloud and its members, managers, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of profits, loss of use, or cost of substitute goods or services, arising out of or related to these Terms or Milkloft, however caused and under any theory of liability, even if we were advised of the possibility of such damages.
  • We will not be liable for any harm arising from reliance on estimated dates, storage windows, projections, plans, suggestions, notifications, widgets, Live Activities, exports, labels, or any other output of the app, including spoiled, wasted, or discarded milk, or milk used past its recommended window; from information you entered incorrectly, incompletely, or late; from events the app cannot detect, such as power outages, appliance failures, or spoilage; from the unavailability, delay, or failure of Apple services, sync, backup, Family Sharing, or notifications; from loss, corruption, or inability to restore your data; or from any use of the app in a professional or institutional setting.
  • Our total cumulative liability for all claims arising out of or related to these Terms or Milkloft will not exceed the greater of (a) the amount you paid to Apple for Milkloft Pro in the twelve months before the event giving rise to the claim, or (b) fifty United States dollars (US$ 50).

These limitations are a fundamental element of the agreement between you and Open Cloud, and Milkloft would not be offered at its price without them. They do not limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, or for any other liability that cannot be limited or excluded under the law that applies to you.

17. Your indemnity

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Open Cloud and its members, managers, officers, employees, contractors, and licensors from any claim, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law or of the rights of any third party, your use of the app in a professional, commercial, or institutional setting, or any document you exported from the app and shared with others. This obligation does not apply to consumers in jurisdictions where such an indemnity is unenforceable.

18. Force majeure

We are not responsible for any failure or delay caused by events beyond our reasonable control, including natural disasters, epidemics, war, terrorism, civil unrest, labor disputes, government actions, failures of the internet or of telecommunications, or failures, changes, or discontinuation of Apple platforms and services.

19. Termination

You may stop using Milkloft at any time by deleting the app; your data on that device is deleted with it, and you can remove the synced copy from your iCloud settings. We may suspend or terminate your license if you materially breach these Terms, if we are required to by law or by Apple, or if we discontinue the app. Termination does not entitle you to a refund except as Apple’s policies provide, and it does not affect data that stays on your device or in your iCloud.

Sections 3 to 9, 13, and 15 to 24 survive termination, together with any other provision that by its nature should survive.

20. Rights you cannot waive

Nothing in these Terms excludes, limits, or waives any right or remedy that applicable law grants you and that cannot be excluded, limited, or waived by agreement. If you are a consumer in the European Economic Area, the United Kingdom, Switzerland, Brazil, Argentina, Mexico, Chile, Colombia, or another country with mandatory consumer protection law, you keep the protection of those laws, and the sections on warranties, liability, indemnity, and disputes apply only to the extent they allow. Where a provision would be unenforceable against you as written, it applies to the maximum extent the law permits, and the rest of these Terms continue to apply.

21. Terms required by Apple

These provisions apply because Milkloft is distributed through the Apple App Store.

  • Acknowledgement. These Terms are between you and Open Cloud only, not Apple. Open Cloud, not Apple, is solely responsible for the app and its content.
  • Scope of license. The license in Section 10 is limited to a non-transferable license to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules set out in the App Store terms, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
  • Maintenance and support. Open Cloud is solely responsible for providing any maintenance and support services for the app, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services for the app.
  • Warranty. Open Cloud is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Open Cloud’s sole responsibility.
  • Product claims. Open Cloud, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
  • Intellectual property claims. In the event of any third-party claim that the app or your possession and use of it infringes that third party’s intellectual property rights, Open Cloud, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
  • Legal compliance. You represent and warrant that you are not located in a country that is subject to a United States government embargo or that has been designated by the United States government as a “terrorist supporting” country, and that you are not listed on any United States government list of prohibited or restricted parties.
  • Developer contact. Open Cloud LLC, [email protected]. Our registered address is published with the app’s listing in the App Store.
  • Third-party terms. You must comply with any applicable third-party terms when using the app, such as Apple’s iCloud terms.
  • Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

22. Changes to these Terms

We may change these Terms from time to time, for example to reflect new features, legal requirements, or changes in how we operate. Each version carries a version date. Changes take effect when the new version is published at milkloft.com/terms, and the app presents them to you with its next update.

  • If a change is material (for example, to the limitation of liability, to how data is handled, to purchases, or to governing law), the app will ask you to accept the new Terms before continuing, and will say what changed. Your data keeps being stored and your reminders keep working in the meantime.
  • If a change is minor (for example, wording, contact details, or clarifications), the app will let you know once, without blocking you.
  • Continuing to use Milkloft after a change is published is your acceptance of it. If you do not agree, stop using the app and delete it; your purchase remains subject to Apple’s policies.

23. Governing law and disputes

  • Governing law. These Terms are governed by the laws of the United States and of the state in which Open Cloud LLC is organized, without regard to conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, you also benefit from the mandatory provisions of the law of the country where you habitually reside.
  • Talk to us first. If you have a dispute with us, email [email protected] with a description of the problem and what you would like us to do, and give us thirty days to resolve it informally before starting any formal proceeding. We will do the same before starting one against you.
  • Courts. Subject to the consumer rights below, any dispute that is not resolved informally will be brought exclusively in the state or federal courts of the state in which Open Cloud LLC is organized, and you and we consent to their jurisdiction. Either party may instead bring an individual claim in small claims court. If you are a consumer in the European Economic Area, the United Kingdom, Brazil, Argentina, Mexico, or another country whose law gives you the right to sue or be sued in the courts of your place of residence, nothing in these Terms takes that right away.
  • Individual claims. To the extent permitted by the law that applies to you, you and we agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative action.
  • Time limit. To the extent permitted by applicable law, any claim arising out of these Terms or Milkloft must be filed within one year after it arises, or it is permanently barred.

24. General

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Open Cloud about Milkloft and replace any prior agreement or communication on the subject.
  • Severability. If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions stay in full force.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign or transfer these Terms or your license. We may assign them to a successor of the Milkloft business; we will let you know through the app or the website.
  • Language. These Terms are published in English and Spanish. Both versions are valid. If they differ, the English version prevails, except where the law that applies to you requires otherwise.
  • No third-party rights. Except for Apple under Section 21, these Terms create no rights for anyone other than you and Open Cloud.
